Rubbish Removal Harrow Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Harrow provides rubbish removal, waste clearance and related services to residential and commercial customers. By booking a collection or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 Service means any rubbish removal, waste collection, clearance, loading, transportation, recycling, disposal or related activity provided by us.
1.2 Customer, you or your means the person, business, company or organisation requesting the Service.
1.3 We, us or our means the rubbish removal service provider trading as Rubbish Removal Harrow.
1.4 Booking means a confirmed request for the Service made by you and accepted by us, whether by telephone, email, online form or other agreed method.
1.5 Waste means any items, materials, refuse or rubbish that you ask us to remove as part of the Service, including but not limited to household waste, commercial waste, garden waste, bulky items and general mixed waste.
1.6 Site means the premises or location from which the Waste is to be collected and where the Service is to be carried out.
2. Scope of Service
2.1 We provide rubbish removal and waste collection services within Harrow and surrounding areas, subject to availability and operational limitations.
2.2 The exact scope of the Service, including the type and approximate volume of Waste, access arrangements, and any special requirements, will be agreed at the time of Booking or, if necessary, upon arrival at the Site.
2.3 We reserve the right to refuse to remove any Waste that we reasonably consider to be hazardous, prohibited, unsafe to handle or unlawful to transport or dispose of.
2.4 Our Service does not include deep cleaning, dismantling of fixed structures, plumbing, electrical work or building works, unless expressly agreed in writing.
3. Booking Process
3.1 You may request a Booking by contacting us via telephone, email or our online enquiry form, providing accurate and complete information about the Waste, approximate volume, access to the Site and preferred dates and times.
3.2 Any quotation provided prior to visiting the Site is an estimate only, based on the information supplied by you. Final pricing may be confirmed on arrival after visual inspection of the Waste and Site access.
3.3 A Booking is only confirmed when we explicitly accept your request and provide you with a date and, where possible, a time window for the Service. We may also require a deposit to secure your Booking.
3.4 You must ensure that an authorised adult is present at the Site at the agreed time to grant access, confirm the items to be removed and approve any changes to the agreed Service or price.
3.5 If you wish to amend your Booking, you must contact us as soon as possible. Any changes are subject to availability and may result in additional charges.
4. Access and Site Conditions
4.1 You are responsible for providing safe, reasonable and lawful access to the Site and to the Waste that is to be removed.
4.2 You must notify us in advance of any access restrictions, parking limitations, time constraints, security procedures, or other conditions that may affect our ability to deliver the Service.
4.3 If parking permits, access codes or special permissions are required, you are responsible for arranging these prior to our arrival. Any parking fees or penalties incurred due to inaccurate information or lack of permits may be charged to you.
4.4 We reserve the right to refuse or suspend the Service if, in our reasonable opinion, Site conditions pose a risk to the health and safety of our staff, the public or property. In such cases, a call-out or cancellation fee may apply.
5. Pricing and Payment
5.1 Our charges are typically based on the volume and type of Waste, the labour required, access conditions, and any additional services requested.
5.2 Unless otherwise agreed, we will confirm the final price on arrival at the Site, following inspection of the Waste and Site conditions, before commencing work.
5.3 All prices are quoted in pounds sterling and may be subject to VAT or other applicable taxes, which will be clearly stated where relevant.
5.4 Unless agreed in advance for account customers, payment is due in full on completion of the Service, and must be made by cash, debit card, credit card, bank transfer or other accepted payment methods.
5.5 If payment is not made when due, we reserve the right to charge interest on the overdue amount at the statutory rate, together with reasonable costs incurred in pursuing payment.
5.6 For commercial or repeat customers, we may, at our discretion, offer credit terms subject to satisfactory checks. In such cases, payment must be made within the timeframe stated on the invoice.
6. Cancellations and Rescheduling
6.1 You may cancel or reschedule your Booking by giving us as much notice as possible.
6.2 If you cancel more than 24 hours before the agreed arrival time, any deposit paid may be refunded or applied to a future Booking, at our discretion.
6.3 If you cancel less than 24 hours before the agreed arrival time, fail to provide access, or are not present at the Site at the agreed time, we may charge a cancellation or wasted journey fee to cover our costs.
6.4 We may cancel or reschedule a Booking if we are unable to provide the Service due to circumstances beyond our reasonable control, including but not limited to vehicle breakdown, staff illness, severe weather or safety concerns. In such cases, we will not be liable for any indirect loss, but any deposit paid will be refunded or the Booking rearranged.
7. Waste Types and Exclusions
7.1 You must clearly identify all items and Waste to be removed and must not include any items that you intend to keep.
7.2 We do not routinely collect hazardous or specialist Waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, fuel, gas bottles, explosives or pressurised containers, unless expressly agreed in writing in advance and subject to additional charges and regulations.
7.3 If hazardous or prohibited items are discovered among the Waste after collection, we may charge additional fees for their safe handling, storage and disposal, and you may be liable for any associated regulatory costs or penalties.
7.4 We reserve the right to decline to remove any item that is unsafe, excessively heavy, fixed to a structure, or not reasonably accessible.
8. Title to Waste and Environmental Compliance
8.1 Once the Waste has been loaded onto our vehicle and payment has been or is contractually due to be made, title to the Waste passes to us.
8.2 We will handle, transport and dispose of Waste in accordance with applicable UK waste management and environmental regulations. Our aim is to maximise reuse and recycling where reasonably practicable.
8.3 We operate under the relevant waste carrier registration and will use licensed facilities for treatment, recycling or disposal, as required by law.
8.4 You confirm that you have the right to transfer the Waste to us for removal and that the Waste does not include items or materials that you are not lawfully entitled to dispose of.
9. Customer Obligations
9.1 You must provide accurate information about the type and approximate quantity of Waste to be removed, and about the Site conditions and access.
9.2 You must ensure that the Waste is ready for removal and that our staff can safely and efficiently load it onto our vehicle without undue delay.
9.3 You are responsible for obtaining any consents from landlords, neighbours, managing agents or other third parties that may be required for us to access the Site or remove Waste.
9.4 You agree not to request our staff to perform any task that may be unsafe, unlawful or outside the agreed Service.
10. Liability and Limitations
10.1 We will exercise reasonable skill and care in providing the Service. However, our liability is limited as set out in this clause.
10.2 We shall not be liable for any indirect or consequential loss, including but not limited to loss of profit, business interruption, loss of opportunity or loss of goodwill.
10.3 We shall not be liable for minor or cosmetic damage to surfaces, driveways, paths, lawns or interior areas that may reasonably occur in the normal course of carrying out the Service, provided we act with reasonable care.
10.4 You must notify us in writing of any claim for loss or damage within 48 hours of the Service being completed, providing full details and supporting evidence. We are not obliged to consider claims made after this period.
10.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
10.6 Subject to the above, our total liability to you arising out of or in connection with the Service, whether in contract, tort or otherwise, shall not exceed the total price paid or payable for the specific Service giving rise to the claim.
11. Insurance
11.1 We maintain appropriate insurance cover for our rubbish removal and waste collection operations, including public liability insurance, in accordance with industry practice.
11.2 Our insurance does not cover items that you did not clearly identify as Waste and that were mistakenly included with the items to be removed. You are responsible for ensuring that items to be kept are segregated from Waste before we attend the Site.
12. Delays and Force Majeure
12.1 We will use reasonable efforts to attend the Site at the agreed time, but all arrival times are estimates and may be affected by traffic, weather, operational issues or other factors beyond our control.
12.2 We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to severe weather, accident, breakdown, industrial disputes, road closures, acts of government or other force majeure events.
13. Complaints
13.1 If you are dissatisfied with any aspect of the Service, you should notify us as soon as possible so that we have an opportunity to resolve the issue.
13.2 We will review your complaint and respond within a reasonable timeframe, requesting any additional information we may need to investigate.
13.3 Where a complaint is upheld, we may, at our discretion, offer a partial refund, a repeat Service, or another form of remedy that we consider appropriate in the circumstances.
14. Data Protection and Privacy
14.1 We will collect and process personal information about you only to the extent necessary to manage your Booking, deliver the Service, handle payments and communicate with you.
14.2 We will take reasonable steps to keep your personal data secure and will not sell or share your details with third parties except where necessary to provide the Service, comply with legal obligations or recover unpaid charges.
15. Variation of Terms
15.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to Bookings made after the updated version is published or provided to you.
15.2 The Terms and Conditions in force at the time of your Booking will apply to that Booking, unless you agree in writing to be bound by a later version.
16. Severability
16.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable by a court or competent authority, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Service, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.
18. Entire Agreement
18.1 These Terms and Conditions, together with any written quotation or confirmation of Booking, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings, representations or agreements, whether oral or written.
18.2 You acknowledge that you have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.
